Summary of Allegations

As a result of a referral by the Inquiries, Complaints and Reports Committee, it is alleged that Mr. Alma, while practising as a pharmacist, committed professional misconduct in that

  • in about June or July 2015, he engaged in inappropriate conduct toward a co-worker and/or sexually harassed a co-worker. Particulars of the conduct alleged to be inappropriate and/or to amount to sexual harassment include:
    • massaging the co-worker’s shoulders and/or neck without permission
    • putting his hand on the co-worker’s thigh, and/or rubbing and squeezing the co-worker’s thigh without permission
    • bringing the co-worker chocolates and/or roses
    • calling the Pharmacy when he was not working to discuss personal matters with the co-worker
    • saying to the co-worker “now don’t take this as sexual harassment, but you look delicious today” or words to that effect
    • saying to the co-worker “you look good in any old thing you throw on” or words to that effect
    • saying to the co-worker “if you taste that good, I’ll have to come over there and lick you” or words to that effect
    • saying to the co-worker “oh look my pants are undone, that is something an old man would do” or words to that effect
    • hugging the co-worker without permission, and/or
    • writing the co-worker a note that contained the words “My dearest Chinaman,” “If you don’t stop analysing me with your mental powers - I will be forced to touch you - severely,” and was signed “Madly” or words to that effect

In particular, it is alleged that he

  • failed to maintain a standard of practice of the profession
  • engaged in conduct or performed an act relevant to the practice of pharmacy that, having regard to all the circumstances, would reasonably be regarded by members of the profession as disgraceful, dishonourable or unprofessional
